We’ll never get Parliament to admit that the Online Safety Act can’t be extraterritorially enforced.

They will never do it. What they will do is they will quietly pivot, adjust their focus onto domestic targets or companies with UK establishments and focus on that, and then all of the extraterritorial stuff will quietly be shelved without anybody noticing.

They can’t afford another 4chan, right? They can’t afford another visible defeat where the full might of the British state went up against a tiny company with webservers in a closet, with a pro bono solo lawyer acting as their counsel in the United States, and losing. I don’t think that’s something that politically they’re going to be able to handle.

They’re not going after Americans like they used to, and that’s the win. The win is to make the behavior stop.

The real win is when we have a statutory shield that ensures that nobody else is going to try it on either.
